1. Overview

Feasr is a pre-feasibility intelligence platform operated by Valcier Labs Pty Ltd (ABN to be added). By using Feasr you agree to these terms.

2. Nature of Service and Limitations

Feasr provides automated pre-feasibility intelligence reports based on publicly available government spatial data, utility network information, and published construction industry benchmarks. Users expressly acknowledge and agree that:

(a) Feasr reports are desktop assessments only and do not involve physical site inspection, engineering investigation, geotechnical assessment, or professional consultation of any kind.

(b) Feasr reports are not and must not be relied upon as: a quantity surveyor's cost report or estimate, an engineering or structural assessment, a town planning report or advice, a legal opinion, financial or investment advice, an environmental assessment, a contamination report, a flood study, a bushfire assessment, or any other form of professional advice regulated under Australian law.

(c) The accuracy of Feasr reports is inherently limited by the accuracy, currency, and completeness of third-party data sources including but not limited to government planning portals, utility network operators, the NSW EPA Contaminated Land Register, the NSW Rural Fire Service Bushfire Prone Land mapping, and construction cost indices. These data sources are maintained by third parties over whom Valcier Labs Pty Ltd has no control.

(d) Data confidence ratings shown in Feasr reports indicate the estimated reliability of specific data points based on known limitations of the underlying data sources. A HIGH confidence rating does not guarantee accuracy. A MEDIUM or LOW confidence rating indicates material uncertainty that must be investigated before any capital commitment.

(e) Feasr reports are intended to be used as a preliminary screening tool only — to identify risks and issues that warrant further professional investigation. A Feasr report should never be the sole basis for a decision to purchase land, commit capital, apply for development approval, or obtain finance.

(f) Property development involves significant financial risk. Users must engage qualified professionals including quantity surveyors, engineers, town planners, and legal advisors before committing to any development project regardless of the findings in a Feasr report.

3. Limitation of Liability

To the maximum extent permitted by Australian law including the Australian Consumer Law:

(a) Valcier Labs Pty Ltd expressly excludes all liability for any direct, indirect, incidental, consequential, special, or punitive loss or damage of any kind arising from or in connection with the use of Feasr or reliance on any Feasr report, including but not limited to: loss of profits, loss of revenue, loss of anticipated savings, loss of business opportunity, cost of substitute services, property acquisition costs, development costs, finance costs, or any other economic loss.

(b) Where liability cannot be excluded under Australian law, the total liability of Valcier Labs Pty Ltd is limited to the amount paid by the user for the specific report giving rise to the claim, which in all cases shall not exceed $990 AUD.

(c) Valcier Labs Pty Ltd is not liable for any loss arising from: inaccuracies or omissions in government spatial data or planning portals, changes to planning controls, zoning, or development standards occurring after report generation, network capacity data that differs from actual utility infrastructure conditions, contamination that is not registered on the NSW EPA Contaminated Land Register, site conditions that differ from those indicated by desktop data sources, or any event beyond the reasonable control of Valcier Labs Pty Ltd.

(d) Users acknowledge that the limitation of liability in this clause is a fundamental term of the agreement without which Valcier Labs Pty Ltd would not provide the service.

4. Data Sources and Accuracy Disclaimer

Feasr uses data from the following third-party sources which are subject to their own terms, limitations, and update schedules:

  • NSW Planning Portal — planning controls updated periodically, may not reflect recent LEP amendments
  • Vicmap Planning Victoria — updated weekly
  • SA Planning and Design Code — updated fortnightly
  • Ausgrid and Endeavour Energy network data — published network capacity data, not a formal network connection assessment
  • NSW EPA Contaminated Land Register — formally notified sites only, does not include unregistered contamination
  • NSW Rural Fire Service Bushfire Prone Land mapping — indicative only, actual BAL requires site-specific assessment
  • Geoscience Australia ELVIS elevation data — terrain elevation, not a registered survey
  • RLB Riders Digest 2025 — indicative construction cost benchmarks, not a project-specific estimate
  • Rawlinsons Australian Construction Handbook 2025 — indicative cost and material benchmarks
  • Cordell Construction Cost Index — quarterly construction cost escalation data

Valcier Labs Pty Ltd makes no representation or warranty that data from these sources is complete, accurate, current, or fit for any particular purpose. Users must verify all data points independently through the original data sources and through engagement of qualified professionals before making any decision.

Cost Estimate Disclaimer: The cost estimates shown in Feasr reports are based on industry benchmark rates applied to user-provided inputs. Actual construction costs depend on final design, site conditions, contractor market conditions, procurement strategy, and numerous other factors that cannot be assessed at pre-feasibility stage. Feasr cost estimates should be treated as preliminary budget allowances only with a contingency of not less than 20% applied.

5. User Acknowledgement

By generating a Feasr report the user confirms that they:

(a) Have read and understood these Terms and Conditions in full

(b) Understand that Feasr is a pre-feasibility screening tool and not a substitute for professional advice

(c) Will not rely solely on a Feasr report for any financial, development, or investment decision

(d) Understand that data accuracy varies by state and data source as indicated by confidence ratings in the report

(e) Will engage qualified professionals before committing capital to any development project

(f) Accept full responsibility for any decision made in reliance on a Feasr report

6. Payment and Refunds

Reports are charged at $990 AUD per report plus GST where applicable. Payment is processed by Stripe. Reports are generated immediately upon payment confirmation. Due to the immediate delivery of digital reports refunds are not available once a report has been generated. Subscription plans are billed monthly and may be cancelled at any time with effect from the next billing cycle.

7. Intellectual Property

All content on feasr.com including the rules engine, report format, data processing methodology, and visual design is owned by Valcier Labs Pty Ltd and protected by Australian copyright law. Users may not reproduce, resell, or redistribute report content without written permission.

8. User Accounts

Users are responsible for maintaining the security of their account credentials. Valcier Labs Pty Ltd is not liable for unauthorised access to user accounts.

9. Privacy

Your use of Feasr is subject to our Privacy Policy.

10. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of New South Wales.

11. Changes to Terms

Valcier Labs Pty Ltd reserves the right to update these terms at any time. Continued use of Feasr following any changes constitutes acceptance of the updated terms.
